Article 1. The school
Classes are given by Aguanilé, the trading name of Mathilda Aditia METANILA, a sole trader (natural person, no share capital) registered in the RIDET under number 1 622 281.001 and based at 5, rue Victor Hugo, Orphelinat, 98800 Nouméa, New Caledonia (hereinafter “the school”). The school can be reached by email at [email protected], by phone or WhatsApp on +687 70.80.50 and by post at that address. Further information about the school is given in the legal notice.
Article 2. Definitions
- Student
- any natural person who registers for an option offered by the school, for themselves or, in the case of a minor, through their legal guardian.
- Option
- the offer chosen at registration: trial class, single class, class pass or plan.
- Plan
- an option giving access, for a set period (month, session or year), to a set number of classes per week, or to all classes for the unlimited plan.
- Season
- the school's yearly period of activity, divided into sessions. The current season runs from February 9, 2026 to November 30, 2026.
- Slot
- a weekly class defined by its style, level, day, time and studio, as published in the timetable.
- Registration
- the contract entered into between the student and the school for an option, under the conditions of Article 5.
- Gift voucher
- a prepaid voucher issued by the school in the form of a unique code, bought by a person (the buyer) to give to someone else or to use themselves (the recipient), under the conditions of Articles 4.7 to 4.10.
Article 3. Purpose and scope
These terms apply to any registration for the group dance classes offered by the school and to any purchase of a gift voucher. They are intended for consumers, that is, natural persons acting for purposes outside their trade or profession.
Private lessons, workshops, parties and event services are subject to specific terms or a quote provided before any commitment. These terms apply to them for anything those specific terms or that quote do not cover. Ordering a private lesson by payment link is governed by Article 5.8.
Specific terms agreed in writing between the student and the school prevail over these terms. Any registration implies acceptance of the terms in force on the day of registration.
Article 4. Offers, benefits, prices and gift vouchers
4.1. For each season, the school offers the following options, detailed on the Prices page:
- Trial class: a first class to discover the school, for 1 000 F, in the group class of your choice and subject to availability. For classes offered on booking, the date of the trial class is confirmed by the school on WhatsApp. Only one trial class is granted per person. Its price is deducted from the option the student then signs up for, within the same season.
- Single class: 2 500 F per class.
- 10-class pass: 19 000 F, valid for 3 months from the date of purchase, usable for all group classes except Casino 1.
- Monthly plans: one, two or three classes a week, with a minimum commitment of 3 months.
- Session (5 months) and year (10 months) plans: one, two or three classes a week.
- Unlimited plan, for a session or a year: access to all classes of the week. The student has a guaranteed place in 5 classes agreed with the school; other classes are open to them subject to availability, with prior booking.
- Private lessons, on request and subject to availability: 8 000 F an hour for one person, 10 000 F an hour for two people; intensive package of 6 lessons at 40 000 F for one person or 50 000 F for two people. Discount for enrolled students, on request.
4.2. An annual registration fee of 1 000 F is added to the first registration of each season. It is payable only once per season. It applies to the monthly, session, year and unlimited plans; the trial class, the single class and the class pass are not subject to it.
4.3. Session and year plans come with the benefits described on the Prices page, including teaching follow-up, access to the school's private groups and, for the year plan, the school t-shirt. Additional benefits are granted to students under 25 and to students registering as a couple; these two benefits can be combined. The school may ask to see proof of age, which it does not keep. Age is assessed on the day of registration. The couple benefit applies to two people who register together for a session or year plan.
4.4. Benefits in kind (bonus classes, private workshop, t-shirt) are personal. They cannot be transferred or exchanged for cash. Bonus classes can be used during the term of the option to which they are attached. The private couple workshop is booked with the school and taken during the term of the plan.
4.5. Promo codes are valid under the conditions stated when they are issued (eligible options, validity period, number of uses). They cannot be combined with each other, with the “under 25” and “couple” benefits, or with referrals. Where the school runs a referral programme, each paid registration by a referred student (single class, class pass or plan) earns the referrer one free class, under the conditions published on the website; the referred student receives no benefit as such and trial classes do not count.
4.6. Prices are stated in CFP francs (XPF). They are net prices, with no TGC (New Caledonia's general consumption tax) to be added: “Régime en base, TGC non applicable” (basic scheme, TGC not applicable). The applicable price is the one displayed on the day of registration or order and repeated in the confirmation. The school may change its prices at any time, in particular from one season to the next; a change has no effect on registrations already made.
4.7. The school sells gift vouchers online, on the dedicated page of the website, in two forms:
- the “value” voucher, for an amount chosen by the buyer under the conditions stated on the website, which is deducted from the price of the school's options and services;
- the “service” voucher, which entitles the holder to the service it specifies (for example a trial class, a single class, a class pass or an intensive package of private lessons), whatever its price on the day it is used.
4.8. The voucher is paid for online by card (Article 6). Once Mobupay has confirmed the payment, the school emails the voucher code and a gift card, to the buyer or directly to the recipient, immediately or on the date chosen by the buyer, and sends the invoice to the buyer (Article 6.7). The voucher can only be used with the school, for its own services.
4.9. The recipient uses the voucher by entering its code when registering or ordering online, or by giving it to the school when registering directly with it. A “value” voucher can be used on one or more occasions until its balance runs out; where the price exceeds the balance, the difference is paid by one of the methods set out in Article 6.1. A “service” voucher is used in one go, for the service it specifies; if that service is no longer offered, the school offers an equivalent service or, at the recipient's choice, a “value” voucher for the amount paid at purchase. A gift voucher cannot be combined with a promo code on the same order. A registration paid for with a voucher is subject to these terms.
4.10. The voucher is valid for twelve months from its purchase; its expiry date is shown on the gift card. After that date, it can no longer be used and any remaining balance is lost, unless the school grants an extension. The voucher cannot be refunded or exchanged for cash, in whole or in part, subject to the right of withdrawal: the buyer of a voucher online may withdraw under the conditions of Article 10, in which case the refund covers the unused balance of the voucher. Anyone holding the code can use the voucher, and the school is not liable for its loss or theft. However, if the buyer or the recipient reports the loss or theft to the school before the voucher has been fully used, the school deactivates the code and, on proof of purchase, issues a new voucher for the balance remaining on the date of the report, with the same expiry date.
Article 5. Registration
5.1. Registration is made using the online form on the website, or directly with the school (at a class, on WhatsApp, by phone or by email). The student provides accurate and complete information and informs the school of any change.
5.2. Online, the student chooses an option and, where applicable, their slots, enters their contact details and payment method, checks the summary of their request and may correct it, then submits the request after reading these terms and accepting them by ticking the box provided for that purpose. If they have chosen to pay by card, they are then taken to Mobupay's secure payment page.
5.3. The school confirms the registration by email and, where applicable, on WhatsApp, stating the option, its price and the payment terms. The registration becomes final upon this confirmation, subject to payment of the price under the conditions of Article 6. Where the student pays online by card, the registration is only binding once Mobupay has confirmed the payment, or the first instalment (Article 6.3): the school then sends the student a confirmation email summarising the option, the slots, the total price, any discounts applied and, where applicable, the instalment schedule. If the payment is declined, abandoned or not confirmed, the registration is not concluded and nothing is payable; any promo code or gift voucher used becomes available again, and the student may submit a new request or choose another payment method.
5.4. The number of places per class is limited. The school may refuse a registration for a legitimate reason, in particular where a class is full or the required level has not been reached. It then offers another class where possible, and nothing is payable for the unavailable class.
5.5. Prior registration is required for:
- single classes;
- classes attended with a class pass;
- with the unlimited plan, classes attended beyond 5 classes a week.
5.6. Classes are open from the age of 11. A minor is registered by their legal guardian, who accepts these terms on the minor's behalf and is responsible for payment of the price. The school may make the admission of a minor subject to a minimum age and to written permission from their legal guardian.
5.7. The information recorded by the school at registration or when an order is placed, in particular its content, the date and time at which these terms were accepted, the version of the terms accepted and, for an online payment, the payment reference and result sent by Mobupay, is evidence of the registration and its content unless proven otherwise. The summary sent by email is the confirmation of the contract on a durable medium; the student is advised to keep it. The school archives registrations, orders and successive versions of these terms as set out in the privacy policy and sends any student who asks for one a copy of their registration and of the terms they accepted.
5.8. Private lessons are arranged directly with the school. Once the service and the slot have been agreed, the school sends the student, by email or on WhatsApp, a Mobupay payment link together with a summary (service, date or schedule, length and price) and a reference to these terms and, where applicable, to the specific terms provided for in Article 3. The order is concluded when the link is paid, as confirmed by Mobupay, which amounts to acceptance of the summary and of these terms; until the link is paid, neither party is bound. The school confirms the order by email and attaches the invoice (Article 6.7). The right of withdrawal applies under the conditions of Article 10.
Article 6. Payment
6.1. The price is payable, at the student's choice, by one of the following methods:
- by cheque;
- in cash, in full;
- by bank transfer, in full: the necessary details are sent directly by the school to the student and are never published on the website;
- by card online, on the secure payment page of Mobupay, a payment solution of SPIRIT SAS (Nouméa trade register 1 630 250, 37 rue Commandant Alexandre Babo, 98800 Nouméa), payment agent of the electronic money institution eZyness, where this payment method is offered at registration or when ordering.
6.2. Payment in instalments is accepted by cheque: in up to 3 instalments for a session plan and up to 5 instalments for a year plan. The cheques are handed over at registration and paid in on a staggered basis, according to the schedule given by the school. The trial class, single class and class pass are paid in a single payment; the trial class is paid on site, on the day of the class. The monthly plan is paid month by month: by cheques handed over at registration and cashed at the start of each month or, once online payment is available, by monthly card payment.
6.3. For card payments, card details are entered directly on Mobupay's secure page: no card data passes through or is stored on the website, and the school only receives from Mobupay the result of the payment (accepted or declined), its amount and its reference. Payment is only deemed made once Mobupay has confirmed it to the school; being redirected to the website after payment is not, in itself, a confirmation.
6.4. Where the school offers it, the price of a session or year plan may be paid by card in monthly instalments, up to the number of instalments set out in Article 6.2, and the monthly plan by a monthly payment until the end of the option. Before confirming their order, the student is shown the instalment schedule: number, amount and date of each instalment, and total amount payable. Instalments are spread over the term of the option and end no later than its end date. The first instalment is paid at registration. The student then authorises Mobupay to store their card securely, without the school having access to its details, and to collect the following instalments automatically from that card on the dates in the schedule, which is repeated in the registration confirmation. The student may ask at any time to update the card used, in particular when it is about to expire. Where the option ends before its term, in particular when the monthly plan is cancelled (Article 7.2), instalments not yet collected are cancelled, without prejudice to sums still owed for the period elapsed.
6.5. If a card instalment is declined, Mobupay may automatically try to collect it again. If the instalment remains unpaid, the school informs the student by email or on WhatsApp and asks them to settle the amount due by updating their card, through a payment link or by another payment method set out in Article 6.1. The same applies if a cheque bounces or a payment is late.
6.6. If the situation is not settled, the school sends the student a formal written notice, by email or by letter, to pay the sums due within fifteen days. If this notice has no effect by the end of that period, the school may suspend access to classes until the sums due have been paid; access is restored as soon as they are paid. Suspension does not end the registration: unpaid instalments remain payable, as do the following instalments on their due dates, unless the student ends their option in the cases provided for in these terms. If non-payment continues, the school may also end the registration in writing; the student then only owes the sums corresponding to the period elapsed until the suspension, calculated in proportion to the price of the option, and the following instalments are no longer payable.
6.7. Every order paid online gives rise to a numbered invoice, sent by email to the student or buyer once the payment or, for payment in instalments, the first instalment has been confirmed. For other payment methods, an invoice or proof of payment is provided to any student who asks for it. Invoices bear the statement “Régime en base, TGC non applicable” (basic scheme, TGC not applicable).
6.8. A student or buyer who disputes a payment is invited to contact the school first (Article 17), which looks into the request as soon as possible and, where appropriate, makes a refund (Article 9.6). This does not deprive the cardholder of the rights granted to them by the regulations with their bank, in particular in the event of fraudulent use of their card. However, where a payment is reversed following an unjustified stop or dispute with the bank (chargeback), although the service has been provided or remains available to the student, the corresponding sums remain payable and Articles 6.5 and 6.6 apply. A gift voucher whose payment is reversed in this way is deactivated.
Article 7. Term and use of options
7.1. Each option is entered into for the term stated at registration: one class for the trial class and the single class; 3 months for the class pass; 5 months for the session and 10 months for the year, within the season; a monthly term, with a minimum commitment of 3 months, for the monthly plan.
7.2. After the minimum commitment period, the monthly plan continues from month to month until the end of the season. The student may end it at any time in writing (email or WhatsApp message), with effect at the end of the current month; the following months are then no longer due.
7.3. No option is tacitly renewed from one season to the next: a new registration is required for each season.
7.4. Plans and class passes are personal: they cannot be transferred, lent or shared.
7.5. A plan gives access to the slots chosen at registration. Changing slots during the option is possible with the school's agreement, subject to availability.
7.6. The season calendar, the timetable and any changes to them are published on the website and announced through the school's usual channels. During school holidays, classes take place every other week, according to the calendar announced by the school. Classes go ahead on public holidays unless the school announces otherwise. Plan prices are set taking this calendar into account.
7.7. Missed classes are neither refunded nor carried over, subject to Article 9. Classes on a pass that have not been used by the end of its validity period are lost and cannot be carried over.
7.8. A private lesson may be cancelled or rescheduled free of charge up to 24 hours before it starts, in writing (email or WhatsApp message). After that, or if the student does not attend, the lesson is due: it is neither refunded nor rescheduled and, in an intensive package, it counts as taken.
Article 8. Cancellation or change by the school
8.1. The school may occasionally have to cancel or move a class, in particular if the teacher is absent or a studio is unavailable. It informs the students concerned as soon as possible. The cancelled class is rescheduled or replaced by an equivalent class; failing that, the student may choose between a credit note and a refund in proportion to the price of the option.
8.2. The school may, for a legitimate reason (in particular too few participants, a change of studio or a reorganisation of the timetable), change the days, times or venues of classes, or merge classes. It informs the student at least fifteen days in advance, unless this is impossible, and offers an equivalent solution. If the change affects an essential element of the registration and the student refuses the proposed solution, they may end their option and obtain a refund of the part of the price corresponding to the remaining period.
8.3. If the school permanently ceases its activity during the season, the part of the price corresponding to the classes not given is refunded to the student.
Article 9. Refunds and suspension for a legitimate reason
9.1. Sums paid are non-refundable, subject to this article, to Articles 8, 10 and 16 and to mandatory legal provisions.
9.2. A student who is prevented from attending classes for at least four consecutive weeks may ask for their plan to be suspended or their class pass to be extended for one of the following reasons:
- a medically certified injury or illness that makes dancing impossible or inadvisable;
- pregnancy;
- a work transfer or a long-term departure from New Caledonia;
- any other serious and legitimate reason, assessed in good faith by the school.
9.3. The request is sent in writing to [email protected], together with supporting evidence (medical certificate, employer's letter or any other relevant document). The suspension takes effect on the date of the impediment shown in the supporting evidence.
9.4. At the student's choice, the suspended period is carried over to the rest of the current season or to the next season, or converted into a credit note valid for twelve months, calculated in proportion to the remaining classes. Where the impediment is permanent (permanent departure from the territory, lasting inability to dance), the student may obtain a refund of the part of the price corresponding to the period remaining from the date of the request; the annual registration fee is retained by the school.
9.5. This article does not apply to the trial class or the single class. The validity of a class pass is extended by the length of the justified impediment.
9.6. Any refund due under these terms or the law is made at no cost to the student, using the same payment method as the one they used, unless they agree to another method: a card payment is refunded to the card used, through Mobupay, and the time it takes for the funds to reach the account then depends on the student's bank; cheques not yet paid in that correspond to the amount to be refunded are returned or destroyed; the part of the price paid with a gift voucher is credited back as a “value” voucher for the same amount. In the event of withdrawal, the refund is made within the period set out in Article 10.5; in other cases, within thirty days of the date on which it becomes due. Instalments not yet collected are cancelled. Each refund gives rise to a corrective invoice, sent to the student by email.
Article 10. Right of withdrawal
10.1. Where the registration is made at a distance (online form, email, phone or messaging), without the student and the school being physically present together, the student has a withdrawal period of fifteen clear days from the conclusion of the contract. They do not have to give reasons or pay any penalty.
10.2. In accordance with the applicable regulations, the right of withdrawal does not apply to the trial class or the single class, which are leisure services provided on a specific date.
10.3. A student who wishes to start classes before the end of the withdrawal period must expressly request it, at registration or in writing. If they then exercise their right of withdrawal, they remain liable for an amount proportionate to the classes attended until they communicated their decision, calculated on the price of the option. The registration fee is refunded.
10.4. To exercise the right of withdrawal, the student sends the school, before the end of the period, a clear statement of their decision to withdraw, by email to [email protected] or by post to 5, rue Victor Hugo, Orphelinat, 98800 Nouméa, New Caledonia, using the model form below if they wish. The school acknowledges receipt by email.
Model withdrawal form: “To Aguanilé, 5, rue Victor Hugo, Orphelinat, 98800 Nouméa, New Caledonia ([email protected]). I hereby give notice that I withdraw from the contract for the following option: ………; registration date: ………; student's full name: ………; date: ………; signature (only if sent on paper).”
10.5. The school refunds the sums paid, less any amount due under Article 10.3, within thirty days of receiving the withdrawal, using the same payment method as the student used, unless the student agrees to another method. Cheques not yet paid in are returned to the student or destroyed.
10.6. A registration made with the student and the school physically present together, in particular at a class, does not give rise to a right of withdrawal.
Article 11. Health, safety and conduct
11.1. Dancing is a physical activity. No medical certificate is required for group classes, unless otherwise stated for a workshop or a private lesson. It is the student's responsibility to make sure, with a doctor if necessary, that they are fit to dance, and to inform the teacher before class of any contraindication, injury, pregnancy or particular situation.
11.2. For safety reasons, the teacher may adapt the exercises offered to a student or ask them not to take part in all or part of a class.
11.3. The student follows the teacher's instructions, the studios' house rules and respects the other participants. Partner dancing and changing partners require respect for everyone: any disrespectful, discriminatory or sexist behaviour, or behaviour of a sexual nature without consent, is prohibited.
11.4. In the event of a serious or repeated breach, the school may, after inviting the student to give their side of the story, except in an emergency, end their registration in writing. The part of the price corresponding to the remaining period is then refunded, without prejudice to compensation for any damage caused.
Article 12. Liability and insurance
12.1. In organising and supervising classes, the school has an obligation of means, in particular as regards safety.
12.2. The school cannot be held liable where the damage results from the student's own conduct, from the conduct of a third party unconnected with the service or from force majeure. Nothing in these terms excludes or limits the school's liability for personal injury or for its own fault.
12.3. Students are advised to have personal liability insurance covering any damage they may cause to others and, where appropriate, personal accident insurance.
12.4. Personal belongings remain in the student's care. The school is not liable for their loss, theft or damage, unless it is at fault.
Article 13. Image rights
13.1. Photographs and videos may be taken during classes, workshops and parties organised by the school, to illustrate and promote its activities on the website, on its social networks (including Instagram, TikTok and Facebook) and in its communication materials.
13.2. The school only publishes an image in which a student is recognisable and singled out with their prior consent. This consent is separate from acceptance of these terms and optional: refusing has no effect on the registration. It is given in writing, by any means (email, message or signed form handed to the school), free of charge and for publication for no more than five years from the date the image was taken.
13.3. For general shots taken at parties and events, in which participants are not singled out, the school informs participants that pictures are being taken. Anyone may object to the publication of an image in which they are recognisable.
13.4. The student may withdraw their consent or object to publication at any time, by telling the teacher or by writing to [email protected]. The images concerned are removed from the media controlled by the school as soon as possible. The school cannot, however, guarantee the removal of copies made by third parties.
13.5. The image of a minor is only published with the written consent of their legal guardian.
Article 14. Intellectual property
The classes, choreographies, teaching materials and content shared by the school, in particular in its private groups, are protected by intellectual property law and reserved for the student's personal use. Recording a class, even in part, requires the teacher's prior consent; publicly sharing it is prohibited without the school's written permission.
Article 15. Personal data
The school processes the student's personal data to manage their registration, in accordance with its privacy policy. Accepting these terms does not amount to consent to any other processing, in particular to the publication of the student's image (Article 13) or to receiving marketing information.
The data needed for online payment is processed by Mobupay, as the school's payment provider, to carry out payments, store the card for payment in instalments and prevent fraud. Card details are entered on Mobupay's page and are never passed on to the school. The privacy policy sets out the data concerned, its recipients and how long it is kept.
Article 16. Force majeure
Neither party is liable for failing to perform its obligations where this results from force majeure, that is, an event beyond its control, which could not reasonably have been foreseen when the contract was made and whose effects cannot be avoided by appropriate measures, such as a cyclone alert, a natural disaster, an epidemic, serious public disorder or an administrative decision closing the studios or restricting travel.
Classes that cannot take place are rescheduled where possible. If the impediment lasts more than thirty consecutive days, the student may obtain, at their choice, a credit note or a refund of the part of the price corresponding to the classes not given and not rescheduled.
Article 17. Complaints
17.1. Complaints are handled directly by the school. The address for handling complaints is:
- Postal address
- Aguanilé, for the attention of Mathilda METANILA, 5, rue Victor Hugo, Orphelinat, 98800 Nouméa, New Caledonia
- [email protected]
- Phone or WhatsApp
- +687 70.80.50
17.2. The complaint states the name of the student or buyer, the option, order or gift voucher concerned and what it is about. The school acknowledges receipt and endeavours to reply as soon as possible.
Article 18. Amicable settlement and mediation
In the event of a dispute, the student and the school seek an amicable solution. The student may also use a mediator or any other alternative dispute resolution method. Mediation is never compulsory and does not prevent the student from bringing the matter before the competent courts.
Article 19. Governing law and jurisdiction
These terms are governed by the law applicable in New Caledonia, in particular the consumer protection rules in force there.
Failing an amicable solution, any dispute concerning their formation, interpretation or performance is brought before the competent courts of New Caledonia, under the ordinary rules and subject to the rules of jurisdiction that protect consumers.
Article 20. Language
These terms are written in French. The English and Spanish translations are provided to make them easier to understand; in the event of any discrepancy, the French version prevails.
Article 21. Changes to these terms
The school may change these terms at any time. The applicable terms are those in force on the date of registration: later changes do not apply to ongoing registrations, unless they are required by law or more favourable to the student. The date of the last update appears at the top of this document.
Article 22. Miscellaneous
If any provision of these terms is held void or unenforceable, the other provisions remain fully effective. The school's failure to rely on a provision does not amount to a waiver of its right to rely on it later.
